Summary of Proposed Changes to Deed Restrictions for Caney Creek Haven

Combined Sections 1, 2, 3 and 4 into one document. Combined the first and second amendments to the deed restrictions into this one document. Removed exceptions for Section 1, Lots 1-5 and Reserve A. Removed exceptions for Section 3, Block 1, Reserve. Re-arranged the restrictions into three sections – Section A. Building Restrictions and Covenants; Section B. Other Restrictions and Covenants; and Section C. Fines and Enforcement. Clarified that property owners can build structures on off-water lots if they have a dwelling house in the neighborhood (Section A. Number 1). Required that structures built on off-water lots (other than a primary dwelling) be located in close proximity to the primary dwelling (Section A. Number 1). Provided for metal siding to be used only on off-water lots (Section A. Number 3). Required that construction be completed within 12 months of commencement (Section A. Number 3 and Number 4). Clarified that if someone is living in a trailer while they work on their home, they can only do this for 12 months (Section A. Number 4). Clarified the prohibition of “traffic-driven business” (Section A. Number 6). Updated the requirements for the Board of Directors (Section B. Number 5) and updated the mailing address (Section B. Number 3). Updated the requirement for approval from 75% of lot owners to 67% based on Texas Property Code 209 (Section B. Number 4 and Section B. Number 6). Added abandoned vehicles, personal watercraft, and boats to restrictions A.8. and B.1. Added late penalty for annual assessment (Section B. Number 3). Removed designation of Caney Creek Haven as a game sanctuary. Added Section C, Fines and Enforcement. Protocol for fines and enforcement to be developed by Board of Directors.
